Purpose

These Terms of Use define the conditions under which users may access and use the FidelIT Pro services, including the SaaS platform and the dedicated hardware terminal provided by La Familiale Exploitation.

Service description

FidelIT Pro is a customer loyalty solution combining access to a SaaS software platform and the use of a dedicated hardware terminal. The service is primarily designed to be used through the terminal, while remaining accessible via a web browser and, where applicable, through an API.

Access to the service

Access to the service requires the creation of a user account. Each account is associated with a single company. The number of users authorized per account may be limited according to the conditions defined by FidelIT Pro. Users agree to provide accurate, complete and up-to-date information.

Service activation

The service is considered activated upon the first use of the FidelIT Pro terminal. This activation constitutes full and unconditional acceptance of these Terms of Use.

Authorized use

Users agree to use the service in accordance with its intended purpose and applicable laws. Any resale of the service, reverse engineering, extraction of data, fraudulent use, or intentional system or API overload is strictly prohibited.

Account suspension or termination

FidelIT Pro reserves the right to suspend or permanently terminate an account, without prior notice, in the event of a breach of these Terms of Use, fraudulent activity, or any action that compromises the security or integrity of the service.

Service availability

The service is provided without any guarantee of availability. Temporary interruptions may occur, including for maintenance operations or due to failures of third-party services such as hosting providers or network infrastructure.

Intellectual property

All elements of FidelIT Pro, including software, trademarks, interfaces, designs and documentation, are the exclusive property of La Familiale Exploitation. Any unauthorized reproduction or use is strictly prohibited.

Data ownership

All data processed through the service remains the property of the client. FidelIT Pro acts solely as a technical host and data processor in accordance with applicable regulations.

Limitation of liability

FidelIT Pro shall not be held liable for indirect damages, financial losses, loss of data, or business interruptions resulting from the use or inability to use the service.

Governing law

These Terms of Use are governed by French law. Any dispute arising from their interpretation or execution shall fall under the exclusive jurisdiction of the courts of the registered office of La Familiale Exploitation.
